VEXEK Sagl provides digital services and downloadable materials which are deemed fully consumed upon purchase or immediate use. By purchasing from our platform, the user explicitly agrees to waive any right of withdrawal or refund under applicable consumer laws, where legally permitted.

This policy applies to:

Digital service packages (e.g., Google Ads, SEO)

Digital downloadable content (PDF guides, templates, etc.)

Subscription-based services (e.g., recurring marketing support)

  • One-Time Purchases:

Once a payment is completed for a service or product:

Access to the service is granted immediately and considered initiated and consumed upon order confirmation.

Downloadable products are provided instantly and cannot be returned or exchanged.

VEXEK Sagl does not accept any refund requests for one-time purchases, regardless of user satisfaction, personal circumstances, or outcomes.

  • Subscription-Based Services:

Some services offered on Profitop.ch are billed on a recurring monthly basis. By subscribing to such services, the user agrees to the following:

Minimum Commitment: The subscription cannot be cancelled or paused during the first three (3) consecutive months of activation.

Cancellation Window: After the initial 3-month period, the user may cancel the subscription at any time, provided that a minimum notice of 7 calendar days is given before the next renewal date.

No Refunds on Past Charges: Cancellations apply only to future renewals. Charges already made will not be refunded, either in part or full.

No Pro-Rated Refunds: If a subscription is terminated during an active billing cycle, access will continue until the end of the current period, but no pro-rata refunds will be issued.

  • Service Delivery and Responsibility:

The client acknowledges that campaign results (SEO ranking, ad performance, traffic, sales, etc.) may vary and cannot be guaranteed due to numerous external factors.

By purchasing a service, the user understands that marketing performance is influenced by industry competition, client input, budget allocation, audience behavior, and other variables beyond VEXEK Sagl’s control.

VEXEK Sagl disclaims all liability for loss of revenue, opportunity, or data resulting from the use or inability to use any part of the service.

VEXEK Sagl is not liable for:

Missed deadlines due to late client communication or approvals.

Poor campaign results due to insufficient ad spend or improper expectations.

Errors or delays caused by third-party platforms (e.g., Google Ads interface, SEO tool providers).

  • Technical Issues & Access Problems:

If the user encounters an access or download issue:

The user is required to notify VEXEK Sagl via info@vexek.com within 72 hours of purchase.

VEXEK will make a reasonable effort to resolve the technical issue or re-provide access.

No refunds shall be granted due to inability to access content caused by the user's device, software, email configuration, ad account suspension, or browser settings.

  • Legal & Consumer Protection Notice:

In line with Art. 40f of the Swiss Code of Obligations and EU Consumer Rights Directive Art. 16, the right of withdrawal does not apply to digital content that is:

Supplied immediately after payment, and

Accessed or consumed electronically upon purchase.

By purchasing on Profitop.ch, the user confirms:

Their explicit consent to begin service delivery immediately.

Their understanding that this waives their legal right of withdrawal or cancellation.

  • Limitation of Liability:

VEXEK Sagl shall not be held liable for:

Indirect, incidental, special, or consequential damages.

Any loss of profits, revenue, data, or goodwill.

Delays or failures due to force majeure events (e.g., natural disasters, internet outages, government restrictions).

All services are provided “as is” and “as available”, without warranties of any kind, either express or implied. The user assumes full responsibility for their use of the service and its outcomes.
